Types Of Constitution | Written And Unwritten Constitution

A constitution is a legislative body that establishes laws in a country and governs them. Any constitution serves a specific function for a nation at a specific time. For example, in 1949, shortly after the Second World War, Germany rewrote its constitution. In 1787, soon after gaining independence from Britain, the USA formed its amended constitution. Every constitution, therefore, serves its purpose. Nevertheless, according to their attributes, all constitutions can be divided into many forms.

The Written Constitution is a type of document or document produced in the form of legislation. Normally, written constitutions are very reliable and systematic. The creation of this constitution is commonly characterized as a deliberate initiative of the people. For a particular period in history, this legal entity is chosen to be the main legal text. Most nations, including the USA, India, Russia, France, Germany, Nigeria, and so on have a written constitution.

The unwritten constitution is a legal entity where the rules have never been enforced as laws. It consists of a country’s different customs, beliefs, or practices. It does not have a particular date of existence and is not in any way transparent or precise. Unwritten constitutions are typically a consequence of a country’s historical growth. The English Constitution is one of the classic examples.

Constitutions Codified and UnCodified

For written and unwritten constitutions, codified and uncodified constitutions are simply another name. A collection of laws created at a particular period of time is the codified constitution. At the same time, the uncoded form of constitution is based on traditions and customs. There are, however, no absolutely codified or uncodified constitutions.

There are uncodified elements of a codified constitution. Take a classic example of the US constitution, for instance. America’s constitution provides for the President to be chosen indirectly. Even so, the elections in the USA are already direct. The uncodified constitution of England has a lot of codified acts of legislation in the same vein.

Constitutions Versatile and Inflexible

This usually applies to how simple it is to amend some of the constitution’s clauses. For when it comes to constitution amendments, codified constitutions have a strict set of laws. One example of inflexible constitutions is the Constitution of the United States. This constitution’s specificity renders it very inflexible for modifications. At the same time, since the 13th century, the British Constitution has continually been evolving.

Republican Constitutions and Monarchy

The Constitution of the Monarchy is one of the different forms of the constitution that gives people of a nation no head of state power unless they are connected to a monarch. This sort of constitution will declare a monarch’s infinite political power or restrict his/her political power.

The most famous constitution today is the Republican Constitution. For all people, it proclaims rights and freedoms. At the same time, it gives the right to select or be chosen as a political leader by political leaders.

Constitutions of the President and Parliament

The Presidential and Parliamentary constitutions depend on the functioning of a government. The presidential constitution puts the power in the president’s hands. A parliament is granted authority by the parliamentary constitution. The head of the executive and head of state branches are mainly influenced by these forms of the constitution.

Usually, the presidential constitution dictates that the president is the head of the state and the head of the executive branch. He/she is not a member of any political party. The parliamentary constitution, on the other hand, dictates that a prime minister should be the head of the state. He/she might be a member of a political party as well.

Federal and Unitary Posts

It is also possible to split constitutions into unitary and federal forms. The federal constitution offers the right to establish state-level governments. They may even have their constitutions in these governments. These should however be related and managed by the central government. No political authority outside the central government is recognized by the Unitary Constitution. Still, at the local level, it can also provide the devolution of power to parts of a country.

Political and Legal Constitution Forms

The constitutional constitution is related to individuals in a country that holds political power. On the notion of majoritarianism, the political constitution is based. It means that legislation that will affect the electorate can be passed by the elected majority. Flexible and changeable is the political constitution. There is a highly scripted legal form of constitution. The Supreme Court is one of the primary proclaimers of this Constitution. This legislative body is required to make all constitutional amendments necessary. The process of constitutional changes is also governed and monitored by this body.
